Release Fund Launched to Free Individuals in Medical Detention

TJI has launched a fundraiser to secure the immediate release of individuals subjected to medical detention. This initiative runs alongside the preparation of strategic class action litigation aimed at challenging the ongoing and unlawful practice of detaining patients in hospitals and clinics solely because they are unable to pay their medical bills.


A Systemic Issue of Arbitrary Detention


Despite a formal shift in government policy in 2023, the practice of medical detention remains widespread across the Democratic Republic of the Congo. Patients who are medically fit for discharge are routinely prevented from leaving healthcare facilities, often held in degrading conditions without any lawful basis.


Those affected are among the most vulnerable in society. Women recovering from childbirth, survivors of sexual violence, newborn babies, children, and the elderly are disproportionately impacted. Many are detained over shockingly small sums.


A Direct and Immediate Impact


The Release Fund provides a practical and immediate response to this crisis. Through trusted local partnerships, TJI is identifying and verifying cases of medical detention in real time. Local lawyers, Mardoche Mutanda and Pelé Cimanga Kalonji, are working on the ground to document individuals’ identities and the precise sums required to secure their release.


Where funds are available, action is swift. Verified medical debts are paid directly to healthcare institutions, enabling detainees to regain their freedom without delay. With nearly 100 individuals already identified—and numbers rising daily—the need is both urgent and growing.


With as little as £50, multiple people can be released. Supporters are invited to contribute and help bring an end to this ongoing injustice.
